Please read these terms carefully. They explain the rules for using our website and ordering our WebAR product experiences.

1. Acceptance of these terms

These Terms of Service ("Terms") apply to your use of https://webaragency.net/ and to the services provided by WebAR Agency ("we", "us", "our"). By using our website or ordering our services, you agree to these Terms. If you do not agree, please do not use the website or our services.

2. Our services

We build WebAR product experiences for e-commerce brands. This includes preparing and optimizing 3D models for the web, building the WebAR experience, hosting it, and providing a link or iframe code so you can place it on your product page. We can also create 3D models from reference photos and product specifications. The exact scope of each project is set out in your quote or written agreement.

3. Quotes, fees, and payment

We price our work by custom quote. Please contact us to receive one. Fees, payment schedule, and any extra costs, such as 3D modeling, are agreed in writing before work begins. Unless stated otherwise, fees are exclusive of taxes and are non refundable once work on your project has started.

4. Delivery times

Once your 3D model is completed, it normally takes 3 to 5 business days to make your WebAR experience. Delivery times are estimates, not guarantees, and depend on the complexity of the product and how quickly you give us materials, feedback, and approvals.

5. Your materials and responsibilities

• You must own, or have permission to use, every model, image, logo, and file you send us.
• You must not send us anything unlawful, infringing, or harmful.
• You are responsible for placing the delivered link or iframe on your own site and for the content of your site.
• You must give us accurate information so we can complete your project.

6. Intellectual property

You keep all rights in the materials and branding you supply. When your project is delivered and paid for, you may use the finished WebAR experience on your own website and in your marketing. We keep all rights in our tools, code, methods, templates, and know how. Nothing in these Terms transfers those rights to you except the right to use the delivered experience.

We may show non confidential project results in our portfolio unless you ask us in writing not to.

7. Agencies and white label partners

If you are a software house, marketing agency, or design studio that resells our work under your own brand, you are responsible for your own clients, for what you promise them, and for making sure they have the rights to the materials they provide.

8. Device and browser support

WebAR depends on the shopper's phone, operating system, and browser. Experiences work on supported devices, such as Android phones with ARCore and iPhones on iOS 12 or newer. We cannot guarantee how an experience behaves on unsupported or outdated devices.

9. Acceptable use of our website

• Do not misuse the website, attempt to break or overload it, or try to gain access you are not allowed to have.
• Do not copy our demos, designs, or content to build a competing service.
• Do not use the website to send spam or anything unlawful.

10. Information on this website

Statistics and industry figures on our website come from third party studies and are shared for general information. They are not a promise that you will get the same results. Your results depend on your products, store, and customers.

11. Disclaimers

Our website and services are provided "as is" and "as available". To the fullest extent the law allows, we do not make any warranties, express or implied, including about fitness for a particular purpose, uninterrupted availability, or that the services will be free of errors.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential losses, or for lost profits, sales, or data. Our total liability for any claim related to our services is limited to the amount you paid us for the specific service that gave rise to the claim.

13. Indemnity

You agree to cover us against claims, losses, and costs that arise from materials you supply or from your breach of these Terms.

14. Suspension and ending

We may suspend or end hosting or services if you breach these Terms, do not pay, or use the service unlawfully. You may stop using our services at any time by telling us in writing. Sections that by their nature should continue, such as intellectual property, disclaimers, and liability, will continue after the services end.

16. Changes to these terms

We may update these Terms from time to time. The date at the top shows when they were last changed. Continuing to use our website or services after a change means you accept the updated Terms.
